These Terms of Service ("Terms") govern your access to and use of the websites, applications, digital tools, and related services made available by Fortix Logistics Business No. 90525 ("Fortix", "we", "our", or "us").
By accessing or using our services, you agree to be bound by these Terms. If you are using our services on behalf of a company or organization, you confirm that you are authorized to bind that entity to these Terms.
Fortix may update these Terms from time to time. Updated Terms become effective when posted on this page, and continued use of the services after posting means you accept the revised Terms.
Section 2: License, Access, and Restrictions
Subject to your compliance with these Terms, Fortix grants you a limited, revocable, non-exclusive, non-transferable license to access and use the services for lawful business or personal purposes.
You may not copy, resell, reverse engineer, scrape, frame, mirror, decompile, or otherwise exploit the services beyond the permissions expressly granted under these Terms.
All platform rights, branding, software, and service content remain the exclusive property of Fortix or its licensors. No ownership rights are transferred to you by using the services.
Section 3: Accounts and Security
You are responsible for maintaining the confidentiality of account credentials and for all actions taken under your account.
You agree to provide accurate information and to promptly update account details where needed.
If you suspect unauthorized access, you must notify Fortix promptly so protective steps can be taken.
Section 4: Service Scope and Operations
Fortix currently operates in Barbados only. Service availability, timelines, and fulfillment commitments are based on Barbados operational conditions.
Fortix may use subcontractors, software providers, or third-party service partners to support logistics operations, payment handling, communications, and account administration.
Fortix is not responsible for delays or failures caused by circumstances beyond our reasonable control, including weather events, road conditions, utility outages, labor actions, or system-wide network interruptions.
Section 5: User Content
If you submit messages, shipment details, reviews, support files, images, or other content through our services, you retain ownership of that content.
You grant Fortix a non-exclusive, worldwide, royalty-free license to host, copy, process, display, and use submitted content as needed to operate, improve, and support the services.
You must not submit unlawful, defamatory, misleading, harmful, or rights-infringing content. Fortix may remove content that reasonably appears to violate these Terms or applicable law.
Section 6: Disclaimers
The services are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
Fortix does not guarantee uninterrupted operation, complete accuracy, or error-free access at all times.
Except where legally required, Fortix disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
Section 7: Limitation of Liability and Indemnity
To the maximum extent permitted by law, Fortix is not liable for indirect, incidental, special, consequential, or punitive losses, including lost profits, lost business, or data loss.
Fortix's aggregate liability arising from or related to the services will not exceed the total amount you paid to Fortix for the relevant service transaction in the three months before the claim, or BBD $1,000, whichever is greater.
You agree to indemnify and hold harmless Fortix, its officers, staff, and representatives against claims or expenses arising from your misuse of the services, breach of these Terms, or violation of applicable law.
Section 8: Dispute Resolution and Governing Law
Before filing formal proceedings, both parties agree to first attempt good-faith negotiation by written notice describing the dispute.
These Terms are governed by the laws of Barbados. Any unresolved dispute shall be brought before courts of competent jurisdiction in Barbados, unless the parties agree in writing to arbitration.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force to the maximum extent allowed by law.
